Cases deal with Eighth Amendment and minimum sentences.
On Tuesday, the Supreme Court heard oral arguments in the cases of Jones v. Mississippi and Borden v. United States.
The case of Jones v. Mississippi takes up a question regarding the Eighth Amendment. The Amendment puts a ban on cruel and unusual punishment. Therefore the court will determine if sentencing a juvenile to life without parole is in violation of that requirement. Specifically, the Court will determine if there is a threshold where it could be a reasonable punishment.
Borden v. United States is having the Justices of the Court taking up a question with the Armed Career Criminal Act. The question before the Court is if a violent crime that involves recklessness counts as the “use of physical force” that would impose a mandatory minimum sentence of 15 years under the Act.
